2) Common law and Civil law Civil law is a modern legal system based upon Roman law and it is based on written codes. Civil law is typical for continental legal system and common law is typical for american legal system.
Common law is based on the precedents created by judicial decisions over time. The judges must be independent and impartial. And they are law makers. Common law is a system of law that prevails in England and in countries historically colonized by England.
